Welcome to World Explorer Tours. These Terms and Conditions govern your use of our website and services. By accessing our website, making a booking, or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

In these Terms, 'we,' 'our,' or 'us' refers to World Explorer Tours, and 'you' or 'your' refers to the user, visitor, or customer.

Booking and Payment

Booking Process

When you make a booking with us, you guarantee that you have the authority to accept and do accept these Terms and Conditions on behalf of your party. A contract is formed between you and us when we issue a confirmation invoice following receipt of your deposit or full payment.

Deposit and Payment Schedule

To confirm your booking, a non-refundable deposit of 20% of the total tour cost is required at the time of booking. The remaining balance must be paid in full at least 60 days prior to the departure date. For bookings made within 60 days of departure, full payment is required at the time of booking.

Payment Methods

We accept payment by major credit cards, bank transfers, and in some cases, cryptocurrency. All payments are processed securely, and your financial information is encrypted during transmission.

Pricing and Accuracy

All prices displayed on our website are per person and are quoted in British Pounds (£). We make every effort to ensure the accuracy of information and pricing; however, we reserve the right to correct errors. If a pricing error occurs, we will notify you before processing your payment and give you the option to accept the correct price or cancel your booking with a full refund.

Cancellations and Changes

Cancellation by You

If you need to cancel your booking, please notify us in writing as soon as possible. Cancellation charges will apply as follows:

Changes by You

If you wish to make changes to your booking after confirmation, we will make reasonable efforts to accommodate your request. However, we cannot guarantee that changes will be possible. An administration fee of £50 per person will apply, plus any additional costs incurred as a result of the change.

Cancellation by Us

In rare circumstances, we may need to cancel your booking. If this occurs, we will offer you an alternative tour of equivalent or higher standard, or a full refund of all monies paid. We will not be responsible for any additional expenses incurred by you as a result of our cancellation.

Changes by Us

We reserve the right to make changes to your tour when necessary. Minor changes may be made without notification. If a significant change becomes necessary (such as a change of accommodation to a lower standard or alteration of tour departure time by more than 12 hours), we will inform you as soon as possible and offer you the choice of accepting the change, taking an alternative tour, or receiving a full refund.

Travel Documentation and Requirements

Passports and Visas

You are responsible for ensuring that you have valid travel documents, including passports, visas, and any necessary health certificates. Your passport must be valid for at least six months beyond the duration of your trip. We cannot accept responsibility if you are denied entry to a country due to non-compliance with these requirements.

Travel Insurance

Comprehensive travel insurance is mandatory for all travelers booking with World Explorer Tours. Your insurance must cover personal injury, medical expenses, repatriation, emergency evacuation, trip cancellation, loss of luggage, and personal effects. We reserve the right to request proof of insurance at any time, and if you are unable to provide this, we may treat your booking as canceled by you with the applicable cancellation charges.

Health Requirements

You are responsible for ensuring that you are physically fit to participate in your chosen tour and that you have received all required vaccinations and health precautions. We recommend consulting with your doctor or a travel health specialist before traveling.

Tour Operation and Conduct

Itinerary Changes

While we strive to operate all tours as described, we reserve the right to change the itinerary due to unforeseen circumstances such as weather conditions, political situations, or operational factors. In such cases, we will make reasonable efforts to provide services of comparable quality.

Group Size

Our small group tours typically have a maximum of 16 participants. We reserve the right to operate a tour with fewer participants or, in rare cases, to combine groups to ensure operational viability.

Tour Leaders and Guides

Our tour leaders and guides have the authority to make decisions affecting the safety and well-being of the group. You agree to comply with their reasonable instructions at all times.

Traveler Conduct

You agree to conduct yourself in a manner that is not disruptive, threatening, or abusive to others, including our staff, guides, and fellow travelers. We reserve the right to terminate your participation in a tour if your behavior is deemed detrimental to the enjoyment of others, without any refund.

Liability and Responsibility

Our Liability

We will accept responsibility for the arrangements we agree to provide or arrange for you as an 'organizer' under the Package Travel and Linked Travel Arrangements Regulations 2018. Subject to these Terms and Conditions, if we or our suppliers negligently perform or arrange the services which we are obligated to provide for you under our contract, and we don't remedy or resolve your complaint within a reasonable period, we will pay you reasonable compensation.

Limitations of Liability

Our liability is limited in accordance with relevant international conventions, including the Warsaw Convention, the Athens Convention, the Berne Convention, and the Paris Convention. Our liability will also be limited to the same extent as the service provider's liability, in accordance with all applicable international conventions.

Force Majeure

We will not be liable for any failure to perform our obligations due to unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even with all due care. These include but are not limited to war, threat of war, riots, civil strife, terrorist activity, industrial disputes, natural or nuclear disasters, fire, adverse weather conditions, epidemics, pandemics, and technical problems with transportation.

Assumption of Risk

You acknowledge that travel involves risks and uncertainties beyond our control. You agree to assume all risks associated with your trip, including but not limited to physical exertion, illness, injury, emotional trauma, property damage, or death.

Complaints and Dispute Resolution

During Your Tour

If you have a complaint during your tour, you must inform our tour leader or local representative immediately to give us the opportunity to resolve the issue on the spot. If the matter cannot be resolved to your satisfaction, you should contact our UK office using the emergency contact details provided in your travel documents.

After Your Tour

If your complaint is not resolved during your tour, you must submit it in writing within 28 days of the completion of your tour, providing all relevant information and any supporting documentation. We will acknowledge your complaint within 14 days and aim to provide a full response within 28 days.

Dispute Resolution

If we cannot resolve your complaint to your satisfaction, you may refer the matter to the Association of British Travel Agents (ABTA) dispute resolution service or pursue legal action through the courts of England and Wales.

Intellectual Property and Content

Website Content

All content on our website, including text, graphics, logos, images, audio clips, and software, is the property of World Explorer Tours or its content suppliers and is protected by international copyright laws. You may not reproduce, modify, distribute, or republish any content from our website without our prior written consent.

User-Generated Content

By submitting reviews, photos, videos, or other content to our website or social media channels, you grant us a non-exclusive, royalty-free, perpetual, transferable, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

Privacy and Data Protection

Governing Law and Jurisdiction

These Terms and Conditions and any disputes arising from them are governed by the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to resolve any disputes arising from these Terms and Conditions or your use of our services.

Amendments to Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time. The updated version will be effective as soon as it is posted on our website. Your continued use of our services after any changes indicates your acceptance of the updated Terms and Conditions.
